§ Article 1 – Purpose and Scope of Application

JoyFromGiving.org (hereinafter referred to as “the Platform”) is operated by the Foundation Joy
From Giving , a foundation registered in Malta under registration number LPF-441. The Platform
aims to facilitate connections between individuals (hereinafter referred to as “Volunteers”) seeking
to engage in volunteering and non-profit public or private organizations (hereinafter referred to as
“Organizations”) offering missions of general interest.
The Parties—Volunteers and Organizations— are expected to exhibit availability, integrity, and an
attitude consistent with the goals of the Platform. They must also adhere to the principles and
values outlined in the National Volunteering Standards and the applicable guidelines of the Malta
Council for the Voluntary Sector, as well as other relevant Maltese laws and regulations
concerning civic engagement and volunteering.

§ Article 2 – Definitions

For the purpose of these Terms and Conditions, the following terms shall have the meanings
defined below:
– “User” : Any individual who creates an account on the Platform, including Volunteers, Matchers,
and Organization representatives.
– “Volunteer”/ “Giver” : Any individual with the legal capacity under Maltese law who seeks to participate
in a volunteer mission facilitated through the Platform.
– “Organization” : Any Maltese legal entity established for non-profit purposes that submits a
mission proposal aligned with the Platform’s objectives and values.
– “Referrer” : The administrative agent responsible for overseeing compliance by both Volunteers
and Organizations with the implementation standards of the Platform.
– “Profile” : Information provided by a User for the purpose of participating in the Platform’s
functionalities.
– “Mission” : A volunteer opportunity proposed by an Organization and published on the Platform.
– “Matcher” : A person selected by the Foundation Joy From Giving to assist Users in identifying
and selecting suitable Missions.

§ Article 3 – Features

§ 3.1 For All Users

The Platform provides the following functionalities for Users:
1. Account creation to input personal information, mission preferences, and relevant skills.
2. Profile visibility for contact by Matchers and Organizations.
3. Account modification or deletion using the “delete my account” functionality.
4. Access to detailed mission descriptions via a search engine.
5. Access to Organization profiles, with the possibility to make donations if such features are
available.
6. Secure messaging to communicate with Matchers and mission managers regarding Mission
details.
7. Posting testimonials following the completion of Missions.
8. Receiving communications and updates from the Platform.

§ 3.2 For Organizations

Organizations using the Platform may:
1. Publish volunteer Missions and promote them through the Platform and its affiliated partners,
including the Engagement API.
2. Offer Missions exclusively to Volunteers who accept these Terms and Conditions.
3. Access secure messaging to communicate with Volunteers.
4. Update or delete Organization pages, including descriptions, logos, and links to websites or
social media.

§ 3.3 For the Foundation Joy From Giving

The Foundation reserves the right to:
1. Validate the registration of Organizations and the publication of their Missions.
2. Monitor behavior on the Platform to ensure compliance with these Terms and the Civic Reserve
Charter.
3. Modify or suggest revisions to the content submitted by Organizations.
4. Approve User feedback for publication on the Platform.

§ Article 4 – Responsibilities

§ 4.1 Responsibilities of the Platform Publisher

As the Platform Publisher, the Foundation Joy From Giving undertakes to:
1. Operate the Platform in accordance with Maltese law.
2. Provide the service free of charge unless otherwise specified.
3. Collect, process, and store data in compliance with the General Data Protection
Regulation (GDPR) and the Maltese Data Protection Act.
4. Ensure the security and confidentiality of all User data.
5. Refrain from commercializing User data or materials submitted to the Platform.
The Foundation Joy From Giving cannot guarantee the accuracy, completeness, or reliability of
the information and documents made available on the Platform. The information provided is
intended as a general service to the public and is subject to updates or changes at any time. The
Foundation shall not be held liable for any damages resulting from the interpretation or use of the
information or materials on the Platform.
The Foundation reserves the right to delete accounts or content that violate these Terms or
applicable laws without prior notice or compensation.
The use of the Platform is governed by the Foundation’s Privacy and Cookie Policy, which details

§ 4.2 Responsibilities of Users

By using the Platform, Users agree to:
1. Abide by the Civic Reserve Charter and any additional applicable guidelines.
2. Use the Platform for lawful purposes only.
3. Provide accurate, truthful, and up-to-date information, particularly concerning profiles and
mission-related content.
4. Notify the Foundation immediately of any unauthorized access to their account.
5. Avoid uploading offensive, defamatory, or inappropriate content.
6. Volunteers are expected to adhere to agreed schedules, complete assigned tasks
responsibly, and maintain respectful conduct toward all parties involved. Any changes in
availability or circumstances affecting their participation must be promptly communicated
to the relevant Organization or the Platform
Users acknowledge that the information and documents available on the Platform are subject to
change. They agree to use the information at their own risk and understand that the Foundation
cannot be held responsible for errors, omissions, or misinterpretations.
Users may report any violations of these Terms through the designated communication channels
provided by the Platform.

§ Article 5 – Updates to the Terms and Conditions

The Foundation reserves the right to amend these Terms at any time to reflect changes in
legislation, Platform functionality, or other necessary updates. Amendments take effect upon
publication on the Website. Users are encouraged to review the Terms periodically.

§ Article 6 – Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malta. Any disputes
arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the
Maltese courts.

§ Article 7 – Data Protection and Privacy

§ 7.1. Compliance with GDPR

The Platform operates in full compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and the Maltese Data Protection Act (Chapter 586 of the Laws of Malta). The Foundation Joy From Giving is committed to ensuring that Users’ personal data is processed lawfully, fairly, and transparently, solely for legitimate purposes related to the functioning of the Platform.

§ 7.2 Types of Data Collected

The Platform collects and processes the following categories of personal data:

  • Profile details.

The Foundation processes Users’ personal data for the following purposes:

 

  • Facilitating connections between Volunteers and Organizations.
  • Enabling Users to participate in Platform functionalities, including communication and feedback.
  • Enhancing the Platform’s usability and performance.
  • Complying with legal obligations and protecting the Platform from misuse or fraudulent activities.
§ 7.4 User Rights

Users have the following rights regarding their personal data:

 

  • Access: Obtain confirmation about whether their personal data is being processed and access a copy of it.
  • Rectification: Request corrections to inaccurate or incomplete data.
  • Erasure: Request the deletion of their data under certain conditions.
  • Restriction: Limit the processing of their data in specific circumstances.
